1. Agreement and Electronic Acceptance
These Terms of Service (the Terms) are a binding agreement between you and Find Your Learning, LLC (FYL, we, us, or our) governing your access to and use of FindYourLearning.community and the related website, map, directory, and community features described below (collectively, the Service).
You accept these Terms when you create an Account or submit content through an electronic acceptance flow that presents these Terms and requires your affirmative assent. If you only browse the Service, your access is conditioned on these Terms. If you do not agree, do not access or use the Service.
The Privacy Policy describes how FYL handles personal information and is available through the Service. The Disclaimer and User Agreement provides additional disclosures about listings, providers, safety, and reliance. The DMCA and Copyright Policy governs copyright notices and counter-notices. The Refund Policy governs refunds of Support Payments. The Disclaimer and User Agreement, DMCA and Copyright Policy, and Refund Policy are incorporated into these Terms by reference.
You consent to receive agreements, notices, and other communications electronically. You may retain a copy of these Terms by printing or saving this page.
2. Definitions
Account means a registered user account on the Service.
Community Flyer means a flyer or similar item that a community member did not create and found in a public source for an event, program, place, Provider, resource, or group that the community member reasonably believes was intended for public distribution.
Community-Shared Listing means a Listing created from information supplied by a community member rather than by the Provider described in the Listing.
FYL-Created Listing means a Listing that FYL creates from publicly available information rather than information supplied by a community member or Provider.
Deal means a free offer, discount, or other promotional term that a registered Provider chooses to display on its own Listing.
FYL Content means the Service and content owned or licensed by FYL, excluding User Content.
Listing means an entry for a class, program, event, place, Provider, or group displayed through the Service.
Private Event means an organizer-created event Listing that displays only the information the organizer designates as visible and withholds selected details, such as a street address, unless the organizer grants access.
Provider means a person or organization that offers a class, program, event, activity, place, resource, or group described in a Listing.
Support Payment means a voluntary, one-time payment made to support FYL. It is not a charitable donation.
User Content means any content or information a user submits, uploads, posts, transmits, or otherwise makes available through the Service, including listing information, flyers, images, group content, comments, provider questions and answers, reactions, and reports.
you means the individual accessing or using the Service. If you use the Service for an organization, you represent that you have authority to bind that organization, and you includes that organization.
3. Eligibility and Geographic Scope
You must be at least 18 years old, have legal capacity to enter into these Terms, and provide the age information required by the registration process to create an Account or submit User Content. Children and other persons under 18 may not create or use an Account.
The Service is offered for use in the United States. You may not use the Service where doing so would violate applicable law. FYL may restrict access from locations it does not support.
4. Accounts
You may register using an email address and password or an available third-party sign-in method. You shall provide accurate information, keep it current, and maintain the confidentiality of your credentials. You are responsible for activity under your Account until you notify FYL of unauthorized use, except to the extent applicable law provides otherwise.
You may not transfer an Account, create an Account for another person without authority, or maintain more than one Account without FYL's written permission. Notify support@findyourlearning.community promptly if you believe an Account or credential has been compromised.
When you first provide a ZIP code during Account setup, FYL derives your state from it and may automatically add your Account to the statewide Welcome group for that state. After that, the Homeschooling state setting in your Account determines your Welcome group: changing it adds the Welcome group for the new state and does not remove you from a Welcome group you already joined. The Privacy Policy explains how FYL uses location information for this purpose.
5. The Service and Editorial Review
FYL is a community map and directory intended to help adults find homeschool and learning-related options. Depending on availability, the Service may allow users to browse Listings; submit Community Flyers or other listing information; create public or Private Events; request access to Private Events; follow places; RSVP to events; join groups; post or comment in groups; react to content; ask public questions on claimed Provider pages; and filter Listings that display a Deal. FYL may also create unclaimed Listings from publicly available information as described in Section 6.
Automated tools may extract text and other details from a Community Flyer submitted by a member. FYL may also use automated extraction on a public event flyer it selects after recording permission or another documented, item-specific lawful basis covering that processing. A human moderator reviews the proposed Listing and any proposed flyer image before display for fit, format, apparent private information, rights concerns, and obvious policy issues. FYL may crop a flyer image to remove incidental background or framing, but does not intentionally alter the flyer's substantive message. For an FYL-Created Listing, FYL independently drafts neutral factual fields from the recorded public source. FYL may format information, select categories, correct apparent transcription errors, merge duplicates, and remove or update content. These activities are editorial functions. They are not credentialing, licensing, background screening, or verification of a Provider or the underlying service.
FYL is not a Provider, school, tutor, childcare provider, event organizer, licensing body, referral service, or agent for any user or Provider. FYL does not guarantee that a Listing is accurate, current, complete, lawful, licensed, insured, safe, available, or suitable for a particular family. Users must confirm material details directly with the Provider and perform their own diligence.
6. Community Flyers, Listings, Provider Claims, and Deals
A Community-Shared Listing is based on information a community member supplied, often from a Community Flyer. The flyer-sharing flow is only for material found in a public source that the submitter reasonably believes was intended for public distribution. A Private Event may be created only by its organizer or a person authorized by the organizer and may not enter the Service through the Community Flyer flow.
A Community-Shared Listing is labeled to show that the information came from a community member. Publication does not mean the Provider supplied, approved, or verified it. FYL may extract factual information from a Community Flyer, keep the submitted source in private storage for review and records, and crop and display the flyer image as the Listing photo to signed-in users. FYL may omit, restrict, or remove a Listing or flyer image in response to a rights, privacy, safety, quality, or accuracy concern.
An FYL-Created Listing carries a clear and conspicuous label identifying FYL as the source of the Listing and stating that the organization has not claimed it. It contains independently written, neutral factual fields drawn from the listed organization's own public materials. No community member or Provider supplied, approved, or verified the unclaimed Listing. FYL does not rate, review, recommend, or evaluate the organization through an FYL-Created Listing.
FYL records the source, collection date, and most recent review date for an FYL-Created Listing. FYL does not promise that public-source information is accurate, current, or complete. An unclaimed dated-event Listing is removed from display after the event ends, and FYL may refresh, restrict, or retire another unclaimed Listing when its source is stale, unavailable, disputed, or no longer supports the displayed information.
For an unclaimed FYL-Created place or organization Listing, FYL does not display a photograph or logo unless the organization supplied it or authorized its use. FYL may use a plain-text organization or event name as reasonably necessary to identify the Listing. If FYL selects a public event flyer itself, FYL does not label the Listing Community Shared and processes or displays the flyer image to signed-in users only after obtaining permission or recording a documented, item-specific lawful basis covering the applicable use.
When a Community-Shared or FYL-Created Listing includes a public Provider business email address, FYL may notify the Provider and offer a process to claim, correct, or remove the Listing. A notice about an FYL-Created Listing identifies FYL as the sender, does not imply an existing relationship or endorsement, and provides a way to decline further promotional email. Claiming a Listing establishes control of the Listing through the email-verification process. After FYL approves the claim, FYL removes the applicable source label and identifies the Listing as Provider-managed. A claim does not establish identity beyond the email-control process and does not mean FYL has verified or endorsed the Provider, its personnel, credentials, licensing, insurance, safety practices, or claims.
A person claiming a Listing represents that the person is authorized to act for the Provider and that information the person supplies is accurate and lawful. The Provider shall review all existing Listing text, images, marks, and source-based details when it claims control. If the Provider chooses to keep existing material after the claim, that material becomes Provider-managed content, and the Provider represents that the information is accurate and that it has the rights, permissions, or other lawful basis needed for continued display. This includes any flyer-derived image. FYL may request additional information, reject or reverse a claim, or restore the applicable unclaimed label if FYL reasonably questions the claimant's authority or the Listing's accuracy.
A Provider that claims or manages a Listing shall keep material Listing information accurate and current, including schedules, prices, age ranges, availability, and any Deal. The Provider shall honor a Deal as displayed for an eligible user during the stated period, subject only to limits clearly disclosed in the Listing. A Deal is offered solely by the Provider. FYL does not create, negotiate, fund, sell, or guarantee it.
A Provider may use personal information received through a family inquiry only to respond to and manage that inquiry or another purpose the family requested or authorized. The Provider may not add the information to an unrelated marketing list or use it for another unrelated purpose without the person's permission.
A user, Provider, listed organization, or authorized representative may report an inaccurate, outdated, duplicate, unsafe, unauthorized, or otherwise problematic Listing using an available reporting tool or by emailing support@findyourlearning.community. An Account is not required to request correction or removal. FYL will review a reasonably supported request promptly and may ask for information needed to confirm authority or locate the Listing.
7. User Content and License
As between you and FYL, you retain ownership of the User Content you own. To the extent you own or control applicable rights, you grant FYL a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, format, adapt, translate, display, distribute, and otherwise use User Content as reasonably necessary to operate, secure, improve, moderate, and provide the Service. For User Content you make public, this license also permits FYL to display and promote that public content in connection with the Service. FYL may exercise the license through service providers acting for FYL. This license reaches only rights you own or control and is not a representation that you grant rights in a third-party Community Flyer.
If you submit a Community Flyer that you did not create, you ask FYL to receive it, review it, use automated tools to extract its factual information, create a proposed Listing, retain the source for moderation and legal records, contact a Provider using contact information printed on the flyer, and consider cropping and displaying the flyer image as the Listing photo. You do not claim to own the flyer or to grant rights you do not control, and you do not represent that you verified the permissions behind its addresses, contact details, or depicted persons. FYL, not the sharing member, makes the editorial decision whether and how to display the flyer image.
The license continues while the User Content is available through the Service. It also continues afterward to the limited extent reasonably necessary for backups, records of consent, legal compliance, dispute resolution, content previously shared with others, and FYL's exercise of rights granted before removal. FYL does not acquire ownership of User Content.
By submitting User Content, you represent and warrant that:
- User Content you create or submit as your own is accurate to the best of your knowledge and is not materially misleading;
- if you submit a Community Flyer, you found it in a public source, reasonably believe it was intended for public distribution, and did not obtain it from a private group, private invitation, access-controlled event, or other nonpublic source;
- for User Content you create or submit as your own, you own it or have the rights and permissions needed to submit it and grant the license above;
- for User Content you create, you will share an address, contact detail, image, or information about another person or family only if it is yours to share or you have permission from the person with authority to give it;
- except for a Community Flyer shared under Section 6, if an image you upload shows another person or a child, you have permission from the depicted adult or from the child's parent or legal guardian to post it in the displayed context;
- User Content you create or submit as your own does not violate these Terms, any person's rights, or applicable law; and
- you will not submit another person's nonpublic personal information, including a private address or contact detail, or a child's name, exact location, direct contact information, or records, without appropriate permission.
FYL may use automated services to read a flyer or image, may remove embedded metadata, and may reject an upload that cannot be processed safely. The Privacy Policy provides additional details.
8. Groups, Private Events, Community Leaders, and Provider Q&A
Group posts, comments, reactions, and Provider questions and answers are visible within their displayed context. The Service does not provide private one-to-one messaging between users. Do not place confidential information in a public field or post.
An organizer may create a Private Event and choose which details are visible before access is granted. FYL may show the town or general area while withholding a street address and other organizer-selected details. A person may request access, and the organizer decides whether to grant it. The organizer and each person who receives access shall not disclose another person's nonpublic information or redistribute withheld event details without authorization. Visibility controls reduce exposure but do not guarantee confidentiality.
A user who creates or manages a group may moderate content and membership within that group as a community leader. A community leader shall keep the group reasonably aligned with its stated focus and region; apply group rules consistently; give a reasonable basis for a decision when appropriate; address content and repeated conduct that violate the rules; request only information reasonably needed to evaluate a join request; and report a credible safety concern to FYL without conducting an independent investigation that could increase risk.
A community leader may use information supplied in a join request only to evaluate and administer that request or another group-related purpose the requester authorized. A leader may not reuse the information for unrelated marketing or another unrelated purpose without permission.
A community leader is not FYL's employee, contractor, agent, or representative and may not speak or act for FYL. FYL remains the final decision-maker for access to the Service and may reverse a group decision or remove any group, leader, user, or content.
9. Prohibited Conduct
You may not use the Service to:
- violate law, another person's rights, or these Terms;
- post content that is fraudulent, deceptive, defamatory, harassing, threatening, hateful, obscene, sexually exploitative, or unlawfully discriminatory;
- create, solicit, possess, distribute, or facilitate child sexual abuse material, sexual exploitation, grooming, trafficking, or other harm to a minor;
- post or threaten to post an intimate image without the depicted person's consent, including a digitally created or altered intimate depiction;
- post another person's nonpublic personal information, including a private address or contact detail, or a child's name, exact location, direct contact information, or records, without appropriate permission;
- impersonate another person, misrepresent affiliation, or claim a Listing without authority;
- share another person's private image, access-controlled event details, private invitation, or other nonpublic material without permission, or bypass a Private Event access control;
- use personal information received through a join request, Provider inquiry, or other limited-purpose interaction for unrelated marketing or another unrelated purpose without permission;
- infringe or misappropriate copyright, trademark, privacy, publicity, or other rights, except that submitting a Community Flyer in compliance with Sections 6 and 7 does not, by itself, constitute a violation of this provision solely because FYL later elects to crop or display the flyer image;
- send spam or unauthorized commercial solicitations;
- scrape, harvest, copy, or bulk-download Service data, or use bots or automated means, except as FYL expressly permits in writing;
- interfere with Service operation, bypass an access control, introduce malicious code, probe for vulnerabilities, or attempt unauthorized access; or
- use Service content or data to build a competing directory, train a machine-learning model, or profile users without FYL's written permission and all legally required consents.
10. Reports, Moderation, and Enforcement
Users may report content through an available in-product reporting tool or by emailing support@findyourlearning.community. A report should identify the content, explain the concern, and provide relevant supporting information. FYL prioritizes reports involving imminent harm, minors, intimate images, private information, and credible safety threats; send those to safety@findyourlearning.community.
FYL may investigate and take action it reasonably considers appropriate, including leaving content in place; correcting, labeling, restricting, or removing content; limiting features; warning a user; reversing a Listing claim; suspending or terminating an Account; preserving information; or referring a matter to a Provider, service provider, law enforcement agency, the National Center for Missing & Exploited Children, or another authority. FYL may act without advance notice when notice could increase risk, compromise an investigation, or violate law.
FYL may moderate in good faith but has no contractual duty to monitor every Listing, post, user, or activity. Review or removal of some content does not create a duty to find or remove similar content. Except for the statutory procedures in Sections 11 and 14, a user may request reconsideration by emailing support@findyourlearning.community, but FYL is not required to provide an appeal in every matter.
11. Non-Consensual Intimate Images
FYL prohibits authentic, altered, or computer-generated intimate visual depictions of an identifiable individual that are posted without the individual's consent. A person depicted, or an authorized representative, may submit a removal request without creating an Account.
Send the request to safety@findyourlearning.community with the subject line Intimate Image Removal Request and include:
- the name and contact information of the requesting person;
- identification of the depicted individual and, if the requester is acting for that individual, the basis of the requester's authority;
- the URL or other information reasonably sufficient to locate each depiction;
- a brief statement that the requester has a good-faith belief the depiction was posted without the depicted individual's consent; and
- the requester's physical or electronic signature.
FYL will, within 48 hours after receiving a valid request, remove a qualifying depiction and make reasonable efforts to identify and remove known identical copies. FYL may request information reasonably necessary to evaluate or complete an incomplete request. FYL will provide a case number or other confirmation when reasonably practicable.
FYL may preserve and disclose information as required by law and may refer suspected criminal conduct to law enforcement or another appropriate authority. Knowingly submitting a materially false request may result in Account action and liability under applicable law.
12. Child Safety and Emergencies
The Service is for adults and is not designed for emergency communications. If a child or any other person may be in immediate danger, contact 911 or the appropriate local emergency service before contacting FYL.
Report suspected exploitation, grooming, trafficking, child sexual abuse material, threats, or other child-safety concerns through the reporting tool or to safety@findyourlearning.community. FYL may restrict content or Accounts while it reviews a report. FYL will make reports and preserve information when required by applicable law, including legally required reports to the National Center for Missing & Exploited Children and child-protection or law-enforcement authorities.
13. FYL Intellectual Property
FYL and its licensors own FYL Content, including the Service's software, design, compilation, text created by FYL, trademarks, and logos. Subject to these Terms, FYL grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for its intended personal or internal organizational purpose.
Except as law permits or FYL authorizes in writing, you may not reproduce, modify, distribute, sell, lease, reverse engineer, create derivative works from, or exploit FYL Content. No license to FYL's names, marks, or branding is granted.
Third-party names, trademarks, service marks, and logos remain the property of their respective owners. In an unclaimed FYL-Created Listing, FYL may use a plain-text name only as reasonably necessary to identify the listed organization or event. FYL does not use a third-party logo, stylized mark, slogan, or branded artwork unless the owner supplies it or authorizes its use. Identification of a third party does not indicate affiliation with, sponsorship by, approval of, or endorsement by that party. A rights owner may request removal or replacement with a plain-text reference by emailing support@findyourlearning.community.
14. Copyright and the DMCA
FYL responds to notices of alleged copyright infringement under the Digital Millennium Copyright Act. The DMCA and Copyright Policy states the requirements for a takedown notice, counter-notice, and repeat-infringer process and identifies FYL's Designated Copyright Agent. An in-product copyright report is not a substitute for a compliant DMCA notice. Send formal DMCA notices to dmca@findyourlearning.community.
15. Third-Party Services and Dealings
The Service may display or link to Providers, locations, websites, products, content, or services operated by third parties and may rely on third-party technology. FYL does not control and is not responsible for a third party's availability, acts, omissions, terms, privacy practices, content, safety, or security.
Any communication, enrollment, attendance, purchase, payment, cancellation, refund, transportation arrangement, or other dealing with a Provider or third party is solely between you and that third party. FYL is not a party, broker, fiduciary, agent, guarantor, or insurer for those dealings.
A Deal is a Provider's offer and not an FYL offer. Confirm eligibility, availability, limits, expiration, and redemption directly with the Provider. FYL does not collect payment for, negotiate, fund, or guarantee a Deal and is not responsible if a Provider changes, withdraws, or fails to honor it. Users and Providers may report an inaccurate or unavailable Deal to FYL.
16. Support Payments
FYL may offer an option to make a voluntary, one-time Support Payment through Stripe. The amount and any applicable charges will be shown before you authorize payment. A Support Payment does not purchase a good, service, membership, enhanced placement, tax deduction, charitable receipt, ownership interest, or influence over moderation.
Support Payments are non-refundable except as stated in the Refund Policy or required by law. Stripe processes payment credentials under its own terms and privacy notice. FYL does not receive your complete payment-card number.
17. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND FYL CONTENT ARE PROVIDED AS IS AND AS AVAILABLE. FYL DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
FYL DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, AVAILABLE, OR ERROR-FREE; THAT A LISTING, FLYER, MAP PIN, PROVIDER STATEMENT, USER STATEMENT, OR AUTOMATED EXTRACTION IS ACCURATE, CURRENT, COMPLETE, LAWFUL, OR SAFE; OR THAT A PROVIDER OR USER IS LICENSED, INSURED, QUALIFIED, TRUSTWORTHY, OR SUITABLE.
Information on the Service is general information, not educational, legal, medical, financial, safety, or other professional advice. Homeschooling and education requirements vary by jurisdiction. You are responsible for confirming and complying with the law and for evaluating each Provider, activity, location, and decision.
Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, the exclusions apply only to the extent permitted by law.
18. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FYL AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITIES; OR LOSS, INJURY, OR DAMAGE ARISING FROM A LISTING, USER CONTENT, PROVIDER, THIRD-PARTY DEALING, OR YOUR RELIANCE ON OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF THOSE DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF FYL AND THE OTHER PARTIES IDENTIFIED ABOVE FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FYL DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) US$100.
The exclusions and cap do not apply to liability that cannot lawfully be excluded or limited. Nothing in these Terms excludes or limits liability for FYL's fraud, willful misconduct, or gross negligence, or for personal injury caused by negligence, to the extent an exclusion or limitation is prohibited by applicable law. These Terms do not limit any non-waivable consumer right.
19. Indemnification
To the fullest extent permitted by law, you shall defend, indemnify, and hold harmless FYL and its members, managers, officers, employees, contractors, and agents from a third-party claim, demand, action, loss, judgment, damage, cost, or reasonable legal fee arising out of or relating to (a) User Content you create, own, control, submit as your own, or adopt and continue to display after claiming a Listing; (b) your unauthorized claim or control of a Listing; (c) your use of the Service in violation of these Terms; (d) your violation of law; or (e) your infringement or violation of another person's rights. This indemnity does not apply to a claim based solely on FYL's decision to create an unclaimed Listing or to crop or display a Community Flyer image submitted in compliance with Section 7. It continues to apply if you knowingly submit material from a prohibited or nonpublic source, materially misrepresent the source, or adopt and retain material without the required rights or lawful basis, or otherwise violate these Terms.
FYL will provide reasonably prompt notice of a covered claim, subject to no loss of rights unless delay materially prejudices the defense. You may control the defense with counsel reasonably acceptable to FYL. FYL may participate at its own expense. You may not settle a claim in a manner that admits fault by, imposes nonmonetary obligations on, or fails to fully release FYL without FYL's prior written consent.
20. Dispute Resolution
Before filing a lawsuit, the claimant shall send a written notice describing the dispute, relevant facts, requested relief, and contact information. Send notice to support@findyourlearning.community and the postal address in Section 24. FYL may send its notice to the email associated with your Account. The parties shall use good-faith efforts to resolve the dispute for 30 days after receipt.
Either party may bring an eligible individual action in small-claims court. Either party may also seek temporary or preliminary relief when reasonably necessary to protect safety, confidential information, intellectual property, Account security, or Service integrity, or to meet a filing deadline. An eligible small-claims action, and a request for temporary or preliminary relief described above, may be filed without first completing the 30-day informal-resolution period. The parties may agree in writing to non-binding mediation, but mediation is not a condition to filing suit after the 30-day period.
These Terms do not require arbitration and do not waive a right to participate in a class or representative action where that right applies.
21. Governing Law and Venue
Texas law governs these Terms and any dispute arising out of or relating to the Service, without regard to conflict-of-laws principles. The state courts located in Travis County, Texas, and the United States District Court for the Western District of Texas, Austin Division, have exclusive jurisdiction, and each party consents to personal jurisdiction and venue there.
The preceding choice-of-law and venue provisions do not deprive a consumer of a non-waivable protection or forum right under applicable law.
22. Changes, Suspension, and Termination
FYL may change, suspend, or discontinue all or part of the Service. FYL may suspend, restrict, or terminate an Account or remove User Content when FYL reasonably believes the action is necessary to enforce these Terms, comply with law, address risk, protect a person or the Service, or respond to inactivity or discontinuation.
You may stop using the Service at any time. You may select Delete my account in Account settings to schedule Account deletion. FYL provides a 30-day grace period during which you may restore the Account through the available one-click restoration flow. If you do not restore it, FYL automatically deletes the Account and information assigned to the deletion workflow at the end of the grace period, subject to the limited retention, legal-hold, safety, and preservation exceptions described in the Privacy Policy. Deletion does not affect rights or obligations that accrued before deletion.
FYL may update these Terms by posting the updated version and changing the Last Updated date. FYL will provide additional notice and obtain new assent when required by law or when a material change requires affirmative acceptance. The updated Terms apply from their stated effective date.
23. General Terms
Entire agreement and order of precedence. These Terms and the incorporated Disclaimer and User Agreement, DMCA and Copyright Policy, and Refund Policy are the entire agreement concerning the Service and supersede prior or contemporaneous agreements on that subject. The Privacy Policy controls for the handling of personal information; the DMCA and Copyright Policy controls DMCA notices and counter-notices; the Refund Policy controls refunds of Support Payments; and the Disclaimer and User Agreement supplements these Terms regarding reliance, Providers, and safety. These Terms control any other inconsistency.
Screen summaries, community rules, Provider rules, and role acknowledgments describe and evidence how these Terms apply to a feature or role. They do not form a separate agreement or change the order of precedence above. If screen text conflicts with these Terms, these Terms control.
Assignment. You may not assign or transfer these Terms or an Account without FYL's prior written consent. FYL may assign these Terms in connection with a merger, financing, reorganization, sale of assets, change of control, or by operation of law.
Severability. If a provision is held unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective.
No waiver. A waiver must be in writing and signed by the waiving party. A delay or failure to enforce a provision is not a waiver.
No agency or third-party beneficiaries. These Terms do not create a partnership, joint venture, employment, fiduciary, or agency relationship. Except for the persons protected by Sections 18 and 19, there are no third-party beneficiaries.
Headings. Headings are for convenience and do not limit interpretation. Including means including without limitation.
Survival. Sections that by their nature should survive termination will survive, including Sections 7 and 13 through 24.
